On December 30, 2009, Alford Shoy (“Shoy”), a firefighter with the local government, pled guilty to the crime of obtaining money by false pretense under title 14, section 834(1) of the Virgin Islands Code in exchange for the People of the Virgin Islands (“People”) dismissing three other criminal charges against him in the same amended Information. Shoy importuned the trial court to sentence him pursuant to 5 V.I.C. § 3711(c), which is a special provision that allows for probation without conviction and for expunction of Shoy’s criminal record.…
