This was an action on the case commenced by the appellee, Julius Suehr, against the appellant, the Sanitary District of Chicago, to recover damages for an injury to the real estate of the appellee, alleged to have been caused by the construction of the drainage'canal of appellant connecting the south branch of the Chicago river with the Desplaines river and the flow of water from Lake Michigan through said canal and the Desplaines river into the Illinois river.
