Reversing.

In February, 1923, appellant was arrested charged with the offense of “drunkenness” and presented for trial in the Laurel county court, wbe-re he was convicted and fined. In this trial appellant on the witness stand denied that he had been drunk as charged. Later he was indicted in the Laurel circuit court charged with the crime of false swearing as denounced by section 1174, Kentucky Statutes. The indictment set out the fact that appellant had been tried in the Laurel county court on the charge of drunkenness, as stated, and, in apt terms,…
