This matter is before the Court on Plaintiff CMA CGM S.A.’s (“Plaintiff’) Motion for Summary Judgment, Doc. 19, Defendant Deckwell Sky (USA) Inc.’s (“Defendant”) Motion to Strike and Motion in Limine, Docs. 21, 25, and the subsequent bench trial held before this Court on February 24, 2015.
