This is a tort action hy Marie Gregory against Gns Thompson based on injuries sustained by appellant as a guest in the automobile of appellee, he being the driver thereof. The case was tried by the circuit judge by agreement as judge and jury. Judgment was rendered in favor of defendant and plaintiff has appealed from this judgment.
