APPEAL from the Sixth District Court of New Orleans,

This is an action by plaintiff, as assignor, to obtain from defendants a certain portion of real estate in this city, and in default thereof to recover the sum of $10,000, as tho stipulated penalty.

The suit is based on the following act, under private signature :

“ To all whom it may concarn : This will serve to certify that, on the 25th day of March, 1862, we, the undersigned, Thomas Griswold & Co., of New Orleans, did sell, bargain and convey to E. A.
