The defendant, Roach, contracted with the Federal Government to construct the “Cabin-Teele” levee in Tensas parish and sublet a portion of the work to Davis, and Davis, in turn, sublet to Arthur Moore. Moore, while building that portion of the levee sublet to him, became indebted to P. P. Williams & Com pany for goods, wares and merchandise obtained and used while the work was in progress. Government engineers in ’.harge of the work made estimates at the end of each month showing the amount due each contractor during the current month.
