Appeal by defendant from a judgment of the Supreme Court, Queens County (Naro, J.), rendered September 10,1979, convicting him of robbery in the third degree, upon a plea of guilty, and imposing sentence. The appeal brings up for review the denial, after a hearing, of defendant’s motion to suppress identification testimony and physical evidence seized by the police. Judgment reversed, on the law, plea vacated, motion to suppress granted as to an out-of-court identification and otherwise denied, and the case is remitted to the Supreme Court, Queens County, for further proceedings.
