The plaintiff in this action for a declaratory judgment, the Board of Cooperative Educational Services of Nassau County (hereinafter called BOCES), is a board of education established in 1967 by the Commissioner of Education pursuant to section 1958 of the Education Law. BOCES’ respon*269sibilities include the providing of special services for emotionally disturbed children.

BOCBS operates a school for emotionally disturbed children, known as the Greentree School, in Hicksville. The school is housed in a former warehouse building which is totally inadequate for the needs of the children. As the…
