The plaintiff charges the defendant with unfair competition. Both are engaged in the manufacture and sale of ice cream. The unfairness as revealed by the evidence consists of: First, the sale of ice cream by the defendant to dealers when these dealers were under contractual obligations to buy ice cream only from the plaintiff; second, the use by the defendant of cabinet-containers for the storage of ice cream in stores when these cabinets belonged to the plaintiff and bore plaintiff’s name; third, the use by defendant of plaintiff’s cans, bearing plaintiff’s name,…
