MEMORANDUM OPINION

KAPLAN, District Judge.

Plaintiff Tradescape.com (“Tradescape”) is a securities broker/dealer that runs a day trading operation, permitting customers to make online stock purchases and sales using Tradescape’s software and computer system. Defendant Sunil Shivaram worked for Tradescape as a software development consultant from October 1998 until July 1999, when he left to form his own day trading business. Along with defendant William Meyers, Shivaram claims that he developed Bulldog, a computer software program that, like Trades-cape’s program, allows for online day trading.…
