OPINION

CHAPEL, Presiding Judge.

¶ 1 Michael Edward Hooper was tried by a jury and convicted of Counts I — III, Murder in the First Degree, in violation of 21 O.S. 1991, § 701.7(A), in the District Court of Canadian County, Case No. CF-93-601.1 The jury found as to Count I that Hooper (1) knowingly created a great risk of death to more than one person, and (2) probably would commit criminal acts of violence that would constitute a continuing threat to society; as to Count II, that Hooper (1) knowingly created a great risk of death to more than one person, (2) probably would commit criminal acts…
