CHAPEL, Judge.

¶ 1 In Tulsa County District Court Case No. CF-2004-2320, Wade Greely Lay was tried by jury and convicted of Count I: First Degree Murder in violation of 21 O.S.2001, § 701.7, and Count II: Attempted Robbery with a Firearm in violation of 21 O.S.2001, § 701.7. At sentencing, the jury found three aggravating circumstances: (1) that the defendant knowingly created a great risk of death to more than one person; (2) that the murder was committed for the purpose of avoiding or preventing a lawful arrest or prosecution; and (3) that a probability existed that the defendant…
