PLATT, District Judge.

This is an action to recover penalties under Act Cong. Feb. 26, 1885, and especially under section 3 of the amendment of March 3, 1891, relating to the importation of alien labor. The first count of the complaint is all that need be quoted to set forth the plaintiff’s claim as it now stands on the record. It is as follows:
