Aurora Medical Group v. Department of Workforce Development

Wisconsin Supreme Court

Decided June 27, 2000No. 98-1546PublishedCited by 18 opinions

1Opinion of the CourtN. Patrick Crooks, J.

¶1. Aurora Medical Group (Aurora) seeks review of a published decision of the court of appeals 1 that affirmed a judgment of the Circuit Court for Milwaukee County, Victor Manian, Judge. The court of appeals held that § 514(a) of the federal Employment Retirement Income Security Act (ERISA) 2 does not pre-empt Kristine E. Meyers' (Meyers) claim under the Wisconsin Family and Medical Leave Act (Wisconsin FMLA). 3 We agree that Meyers' state law claim is not pre-empted by federal law, and therefore affirm the decision of the court of appeals.
