(after stating the facts as above). From the findings of fact and the decision of the referee it will be observed that his conclusion that the plaintiff should prevail in this controversy is based upon three propositions: First. That the Department of the Interior was not divested of jurisdiction on the issuance of the deed to Word, and that it had full authority to determine the controversy. Second.
