The plaintiffs appeal from a Superior Court judge’s order allowing summary judgment in favor of the defendants Roger O’Neil and his employer, New England Telephone and Telegraph Company (NYNEX), in this tort action involving a pedestrian struck and gravely injured by an automobile. The issue presented is the legal effect of the defendant O’Neil’s stopping his van and signaling the teenage pedestrian, the plaintiff Amy Woods, to proceed, as she stood on the double yellow line of a four lane road.
