A. INTRODUCTION
On June 14,1990, RESOLUTION TRUST CORPORATION (“RTC”), as Receiver for the Plaintiff in this proceeding, NASSAU SAVINGS AND LOAN ASSOCIATION (“the Plaintiff”), filed a Motion for Partial Summary Judgment (“the Motion”) pursuant to Bankruptcy Rule (“B.Rule”) 7056 seeking judgment in its favor with respect to Count VII of the Complaint in the above-captioned proceeding.
