This appeal is the product of a long and bitter marital dispute between the plaintiff, Dr. Kurt Rosenbaum, and his wife, the defendant, Mrs. Jean Rosenbaum. The case before us, although begun by Dr. Rosenbaum as a suit for partition of their home, was later amended to include a count for divorce on the ground that his wife was guilty of mental cruelty.
