CUMMINGS, Circuit Judge.
Arthur Lister sued the Sun Electric Corporation, the Sun Electric Corporation Pension Trust (“Trust”) and two trustees of the Trust in state court, seeking a declaration that he was entitled to “uninterrupted service credit for the period from July 1964 to January 1971 for the purpose of calculating his pension benefits.” Complaint TUT 20(a) and 25(a). The defendants removed the case to federal district court, alleging that Lister’s claims were preempted by the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §§ 1001-1461.
