Richard Seeden, plaintiff appellant, filed his suit in the circuit court of Du Page county, Illinois, against Erwin F. Kolarik, defendant appellee, for personal injuries arising out of an automobile accident. The complaint alleged that the defendant, while operating his automobile on a public highway, negligently ran into' the plaintiff who was walking on the highway, causing him serious personal injuries, for which he asked damages. The defendant denied these charges and after a jury trial, was found not guilty. The usual motions were presented to the court by the plaintiff after verdict.…
