In May, 1921, defendant entered into a contract with one John Moore to haul the material *644to be used in erecting a stadium for the University of Michigan at Ann Arbor from the railroad depots. The price agreed upon was $1.25 per hour for a man, team and wagon. Moore had for several years been engaging in the teaming and trucking business. He owned several teams and wagons and employed drivers therefor. He also hired men with teams and wagons, paying them $10 per day.
