BARNHILL, J., joins in concurring opinion. The pertinent parts of the agreed statement of facts, submitted to the court below for the determination of the questions involved in this action, are as follows:

"I. That the plaintiff is a municipal corporation, duly chartered, organized and existing under the laws of the State of North Carolina.
"II. That, pursuant to Section 6, Chapter 56, Public Laws of 1915, now C. S., 2708, the governing body of plaintiff, on May 5, 1925, passed an original resolution providing for certain street paving improvements and the manner of payment of the assessment…
