SPROUSE, Circuit Judge:

The Potomac Electric Power Company (PEPCO) appeals from the district court’s summary judgment in favor of Steven Sachs, Attorney General of the State of Maryland (Maryland), in PEPCO’s declaratory judgment action, 639 F.Supp. 856. PEPCO sought a judgment holding that the federal Toxic Substances Control Act (TSCA)1 preempts Maryland’s hazardous waste laws and regulations,2 which, among other things, govern the use and disposal of polychlorinated biphenyls (PCBs).
