MEMORANDUM AND ORDER

This matter is before me on Defendant LVNV Funding, LLC’s Motion to Dismiss *1155in this Fair Debt Collection Practices Act, 15 U.S.C. §§ 1692 et seq. (“FDCPA”), action. The issues are fully briefed and I have heard oral argument on the motion. For the reasons that follow, I will grant in part and deny in part defendant’s motion to dismiss.
