CARDAMONE, Circuit Judge:

George Heath, pro se, appeals from a judgment entered May 7, 1985 in the United States District Court for the Northern District of New York (Munson, C.J.), denying his petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 (1982), and seeks assignment of counsel. This case illustrates the unreliability of the proverb “where there’s smoke, there’s fire.” Cf. Lyly, Euphues (1579).
