The executors of the will of Thorvald Maijgren, deceased, have petitioned this court for a determination of the ownership of 119 shares of the corporate common stock of the Electro Surgical Instrument Co., and for a construction of the will to determine the validity and effect of certain provisions in the bequests of testator’s stock holdings in said corporation. Upon the hearing it appeared that the residuary legatees are interested in the construction question, but had not been cited.
