This is an appeal from a judgment in the circuit court refusing to set-aside and vacate a default judgment rendered against plaintiff herein in the justice court of Marion D. Waltner of Kaw Township, Jackson county, Missouri, and to enjoin the enforcement of .said judgment.

The judgment attacked was based upon a suit for damages instituted by George W. Ronksley against Herman R. Scheerer. doing business as Economy Market, arising out of a collision between an automobile be longing to the plaintiff therein and a truck owned by the defendant in said suit.
