This is an action by the widow of J. L. Agnew, deceased, to recover damages resulting from his death which she alleges was caused by negligence of defendant. The answer is a general denial. Plaintiff recovered a judgment in the circuit court and defendant appealed.

• The death of Agnew occurred at about six o’clock in the morning of November 11,1909, near the intersection of Seventeenth and Wyoming streets in Kansas City.
