Appeal from a judgment of the Supreme Court (Connor, J.), entered November 8, 1995 in Greene County, upon a dismissal of the complaint at the close of plaintiffs case.

In 1989, defendants purchased a parcel of real property in the Town of Catskill, Greene County, for business and investment purposes.
