After the argument and submission of this cause on the merits, defendants in error filed a motion to dismiss the writ of error for the reason that certain maps and exhibits used at the trial were not incorporated in the record. We find, on examining the record, briefs of counsel, and exhibits filed with tbis motion, that some of the large and cumbersome original maps and exhibits, the absence of which furnished the occasion for the present motion, were, by an order of the trial court made by consent of both parties, sent to this court for use in the argument, without incorporation in the bill…
