MITCHELL, Justice.
On 6 July 1992, the Hoke County Grand Jury indicted the defendant, Bernice Hugh McDougald, for first-degree murder, conspiracy to commit first-degree murder, assault with a deadly weapon with intent to kill inflicting serious injury and discharging a firearm into occupied property. Upon the defendant’s motion, venue was changed to Scotland County. The defendant was tried capitally at the 24 September 1992 Criminal Session of Superior Court, Scotland County.
