McKAY, Circuit Judge.

In 2008, the Food and Drug Administration’s Office of Criminal Investigation opened an investigation into two purported clinical weight-loss studies. Participants were solicited for these purported studies between 2006 and 2008 by Defendant John Edward Mullikin. As a result of this investigation, Defendant was indicted by a grand jury sitting in the District of Colorado in November 2011. The indictment consisted of nineteen counts of mail fraud.
