David McLaughlin, alias Lewis Davis, was tried under an indictment charging him with the offense of murder, it being alleged that he shot and killed his wife, Selma. Two witnesses, testifying that they saw the shooting, swore that the accused shot his wife four times,, once in the breast and three times through the bowels, inflicting mortal wounds from which the woman died in two or three hours. This court will not interfere with the discretion of the trial judge in refusing to grant a motion for the postponement of .a criminal ease to allow counsel to prepare for trial, where it is not made to 'appear that there has been a gross abuse of discretion, or that the trial judge has displayed a want of consideration for the rights of the accused, which amounts to a denial of a fair trial.
