Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Following a search of petitioner’s cube, he was charged in a misbehavior report with possession of contraband, stolen property and altered property, misuse of state property and unauthorized exchange, organizational activity and assembly. *1461Petitioner was found guilty of all charges following a tier III disciplinary hearing.
