In this case, the appellee, as plaintiff, alleged, in substance, in his complaint, that the appellant, as defendant, was indebted to him in the sum of one hundred dollars, for work, labor and services rendered by the appellee for the appellant, at his instance and request, in making sale of the appellant’s land in Fulton county, Indiana., to one Alfred T. Sheets, on or about the 11th day of June, 1877, which sum was due and wholly unpaid, and for *415which and for all other proper relief the appellee demanded judgment.
