Appeal from a judgment of the County Court of Albany County (Turner, Jr., J.), rendered December 20, 1990, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree.

Defendant was charged and convicted of criminal sale of a controlled substance in the third degree arising out of events which occurred in the City of Albany on July 12, 1989. A *682prison sentence of 12 to 25 years was imposed on defendant as a second felony offender.
