MEMORANDUM OPINION AND ORDER

I. INTRODUCTION
On January 25, 2002, the Motion to Certify Class [Doc. No. 62] of Plaintiff David Egge (“Egge” or “Plaintiff’), and the Motion to Deny Class Certification [Doc. No. 58] of Defendant Healthspan Services Company d/b/a Reliance Recoveries (“Reliance”), were argued before the undersigned United States District Judge.
