This appeal by the husband is from only so much of a judgment of the 55th District Court of Harris County, sitting without a jury, as, pursuant to Article 4638, Vernon’s Texas Civil Statutes, divided between them the estate of himself and his wife; the further part of the decree, awarding her a divorce, not being called in question in this court by him, although he excepted below generally.
