—In an action, inter alia, to recover damages for personal injuries, the plaintiffs appeal from an order of the Supreme Court, Queens County (Golia, J.), dated June 6, 1997, which granted their motion pursuant to CPLR 3126 to strike the answer of the defendant Rudija Balic only “to the extent that the defendant Balic shall be precluded from offering any testimony unless he submits to a deposition no later than 45 days prior to trial”.
