MEMORANDUM OF DECISION

The matter before the court is a complaint filed by Pester Refining Company (“Pester”) that seeks to prevent the Insurance Company of North America (“INA”) from cancelling an insurance policy. Pester filed a petition under Chapter 11 of the Bankruptcy Code on February 24, 1985, and is a debtor-in-possession in the underlying bankruptcy proceeding.
