Grifhahn v. Kreizer

Appeal by the defendant, Bernard Kreizer, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 18th day'of October, 1900, upon the verdict of a jury for $7,500, and also from an order entered in said clerk’s office on the 23d day of October, 1900, denying the defendant’s motion for a new trial made upon the minutes.

Jenks, J.:
The action is for negligence brought against the lessee of a business building who subleased to Various tenants, and who furnished and maintained a freight elevator therein for their common use. The deceased, an expressman, being engaged upon the premises in the lawful business of a tenant, was there upon the implied invitation of the defendant, who owed to him the duty of exercising reasonable care in seeing that the premises, including this elevator, were safe.
