The defendant, Alfred Presnell, was jointly charged in the district court of Payne county, Okla., with one Richard Mansker and one Bill Foster with the ■crime of burglary in the second degree. A severance was granted; the defendant, Alfred Presnell, was tried, convicted, and sentenced to serve a term of two years in the State Penitentiary, and has appealed to this court.
