Kirk Hughes, the defendant, brought before this court an omnibus motion directed at the indictment herein by which he is charged with rape in the first degree, in violation of subdivision 1 of section 130.35 of the Penal Law; burglary in the first degree, in violation of subdivision 2 of section 140.30 of the Penal Law; and assault in the second degree, in violation of subdivision 6 of section 120.05 of the Penal Law.
