POSNER, Circuit Judge.

Although Milagros Irizarry has lived with the same man for more than two decades and they have two (now adult) children, they have never married. As an employee of the Chicago public school system, she receives health benefits but he does not, even though he is her “domestic partner” (the term for persons who are cohabiting with each other in a relationship similar to marriage), though he would if he were her husband. In July 1999, the Chicago Board of Education extended spousal health benefits to domestic partners — but only if the domestic partner was of the same sex…
