OPINION
BARRY, District Judge.
I. INTRODUCTION
This action is brought by the United States against the Board of Education of the Township of Piscataway (“Board”) under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. The United States alleges that the Board discriminated against Sharon Taxman by terminating or laying her off from her position as a school teacher at Piscataway High School on the basis of her race and by failing and refusing to take appropriate action to remedy the alleged discrimination.
