This was an application of Lake, a deputy sheriff of the county of Newport, addressed to the Court of Common Pleas, for permission to amend his return on an execution. The application was heard by the Court of Common Pleas, Durfee, C. J., and Matte-son, J., and the following opinion given thereon : —

This is a motion for leave to amend a return on an execution. The execution issued on a judgment- recovered by Preston B. Richmond, tax collector, against Edward W. Howland, in the Court of Common Pleas, in Newport, in May, 1881. It was served by the petitioner as deputy sheriff by levy upon all the right, title, and interest of said Howland in two parcels of land in Little Compton. A sale under the execution took place pursuant to notice, February 13, 1882.
