This dispute arises from Plaintiff Cincinnati Insurance Company’s desire for a declaration that it has no duty to defend or indemnify Defendant . Berkshire Refrigerated Warehousing, LLC in another lawsuit in which Berkshire has been sued for the theft' of equipment lodged in its storage facility.
