Appeal by defendant (by permission) from an order of the County Court, Nassau County, entered October 8, 1976, which denied, without a hearing, his application to vacate, pursuant to CPL 440.10, a judgment of the same court, rendered July 21, 1975, which convicted him of grand larceny in the third degree, upon his plea of guilty, and sentenced him to an indeterminate term of imprisonment not to exceed three years. Order reversed, on the law, and proceeding remitted to the County Court for a hearing and a new determination in accordance herewith, to be held before a Judge other than the one…
