*597Before the Court is defendants' motion to dismiss.1 For the following reasons, the motion is granted in part and denied in part.

I. BACKGROUND

This case arises out of a dispute over use of the name "St. Roch Market."2 The original St. Roch Market is located at 2381 St. Claude Avenue, on the neutral ground of St. Roch Avenue. It is one of the few remnants of the once-extensive network of public markets in New Orleans.3 The City leased stalls in St. Roch Market to various food vendors from the 1800s until 1945.4 From 1945 until the 1990s, the City…
